Report Violation

Post by bionic_one » Wed Mar 02, 2011 12:50 pm

I think this fishing report shows a violation of regulations.

Link to Report

You are not allowed to continue fishing after you've caught your limit, even if it's C&R
You are not allowed to catch and release trout when using bait

Wow aren't you cool. Generally, the moderators will remove reports that have rules violations.

Well he didn't say if the fish that were released were caught on the bait or the Kastmaster/Roostertails. And yes the rules you stated would indicate that he needed to quit fishing as soon as he had kept the 5th fish/limit. So even if the released fish were caught on the hardware, it was still illegal to continue to fish. Mike or Aaron would need to decide if that report needs to be deleted. The regular Moderators can't do that.

Sounds to me as though he caught 4 on bait and C&R'd with lures for a while. Perfectly legal.

If a person did indeed break a rule then that person needs to be informed of what rule was broken and given the choice to have the report edited to remove any incriminating statements or deleted in its entirety. To leave it "as is" may suggest that the site and its members condone the activity.

Now for the continuing to fish after a limit has already been caught, the rules aren't as clear as they used to be. The only specifics I could find were with adult salmon, sturgeon and special rules by body of water. After you bag your adult salmon limit, you're done for the day. With sturgeon, you may continue to catch and release and with some lakes there are specific rules when eastern brook trout are involved. I suppose the thought behind this may be that once you bag 5 trout you can always target a different species. That being said, Burke was rehabilitated and should only contain trout at this time. I think this would be a great question to pose to enforcement to get a definitive ruling.

By the way, I have had to ask to have one of my reports edited due to a stupid mistake on my part, so don't feel singled out if a member points out a mistake.

The rule for sturgeon only applies in the Columbia. You can continue to C&R sturgeon after you have retained your keeper for the day, but fishing any other systems (such as the Chehalis River, northern PS fisheries, etc.) you must STOP fishing once you have retained a legal keeper.

I posted a response on the report thread:

Thanks guys for the civil way this was handled. I will leave it up to scoutii304 how he wants to handle the report from here. The comments serve as a good educational tool for anglers so I hate to just delete the report outright.

If I find reports that have gross violations (I know, that's in the eyes of the beholder) they get deleted immediately. In this case however I do think it's a good educational opportunity that reminds anglers just what the rules are on catch and release and fishing up to but not over limits. In that sense this works well as a "Public Service Announcement" with the understanding that none of us condone or support illegal fishing practises, but also realizing the angler in question obviously wasn't intentionally breaking the rules.

It's great that the members on the site keep an eye on things and report violations. With over 5,000 reports a year some are bound to slip through. Thanks again.

Oh yeah, super jealous of 14" trout. This report isn't really a big deal, and like I said in the report thread, it sounded like he didn't mean to do it - but it's important that people know, so they don't read it, and go off and do the same thing. Maybe you just don't care about laws and rules? Seems to be pretty common these days.

quite the opposite I follow rules and it had made me fairly succesful in life. I also learned that minding my own business is best. Now I would step In if needed, but not for somebody going over there limit and I sure wouldnt point it out for the whole world to know they made a mistake.
