NWFR Advertising Policy

NWFR accepts advertising from third parties ("Advertisers"), which may include third party banners, badges, contextual advertising and content created or provided by an Advertiser (collectively referred to as "Advertisements" or "Advertising"). In addition, as used in this policy, the terms "Advertising" and "Advertisements" include third party banners, modules, links, microsites, native advertisements and other content provided by or on behalf of Advertisers. The Advertiser is responsible for the accuracy and objectivity of their Advertising. The following guidelines have been established by NWFR to govern various aspects of Advertising with us.

The guidelines in this policy govern issues like acceptance of Advertisements by NWFR, how Advertisements are displayed on the NWFR Website, and the removal of Advertisements from NorthwestFishingReports.com. NWFR has sole and absolute discretion with respect to interpretation and enforcement of this policy and all other issues associated with Advertising on NWFR. NWFR may change this policy at any time in its sole discretion by posting a revised policy.

  • NWFR has sole discretion for determining the types of Advertising that will be accepted and displayed on the NorthwestFishingReports.com, and under no circumstances will NWFR's acceptance of any Advertisement be considered an endorsement of the product(s) and/or service(s) advertised or for the company that advertises, manufactures, distributes, or promotes the products or services.
  • NWFR will not knowingly accept Advertising that, in NWFR's opinion, is not factually accurate and in good taste.
  • There are certain categories of Advertisements that NWFR will not knowingly permit at any time. These categories include but are not limited to the following:
    • Illegal, 'objectionable', 'ineffective' and/or 'dangerous' products (NWFR reserves the right to determine what is 'objectionable', 'ineffective' and/or 'dangerous')
    • fraudulent, deceptive, illicit, misleading or offensive material
    • material that misrepresents, ridicules, discriminates (real or implied) or attacks an individual or group on the basis of age, national origin, race, religion, gender, sexual orientation, marital status, disability or any other status deemed inappropriate by NWFR
    • gambling
    • pornography or related themes
    • the simulation of news or an emergency
    • media or messages for or that reference "M" rated video games or content
    • unreasonable, unlikely or extraordinary product or service claims
    • advertising units that mimic computer functions or deceptively indicate a computer or other function that would be reasonable to the average user to assume as a reason to click the unit
  • NWFR recognizes and maintains a distinct separation between Advertising and NWFR's editorial content. All Advertising on NWFR will be clearly and unambiguously identified, ie "Sponsored Content". NWFR will not allow any Advertising that is not identified with the label of "Advertisement", "From Our Advertiser", "Information From Industry", "Sponsored Content" or a similar designation indicating that the Advertising is being provided by or on behalf of an Advertiser.
  • A click on an Advertisement may only link the end user to the Advertiser's site or to relevant sponsored content area on NWFR.
  • NWFR retains the exclusive right to determine how any and all search results for specific information by keyword or topic are displayed on NWFR based on NWFR delivered search results.
  • NWFR participates in various banner ad advertising networks. These Advertisements that have been purchased by companies from the ad networks, within parameters provided by NWFR, and have no affiliation with NWFR.
  • NWFR reserves the right to decide at any time in its sole discretion whether it will accept, reject, cancel, or remove Advertising. NWFR cannot provide any assurances that Advertisements will perform without error on all platforms, including websites and mobile applications.
  • It is the Advertiser's responsibility to comply with all domestic and foreign laws and regulations applicable to its Advertising on NorthwestFishingReports.com. NWFR will not monitor compliance with such laws and regulations. However, NWFR reserves the right to review all Advertising for compliance with applicable laws and regulations and, if NWFR becomes aware of any breach or potential breach of any applicable law or regulation or of these guidelines, NWFR may remove the Advertising.
  • No Advertising on NWFR shall include any pixels, tags, flash containers or any other type of information collection software code (any such pixel, tag, code or device a "Pixel") or shall place any beacons, cookies or other information collection devices on the browsers of users of NWFR unless expressly approved in writing by NWFR.

TV Advertising Terms & Conditions

  1. Sponsorship of NWFRTV, NWFR, or any DA production or product is paid advertising. No other rights, benefits or entitlements are bestowed on the “sponsor” that are not explicitly outlined in writing. DA reserves the final decision on any disputes over agreed advertising elements.
  2. NWFR has sole discretion for determining the types of Advertising that will be accepted for NWFRTV, and under no circumstances will NWFR's acceptance of any Advertisement be considered an endorsement of the product(s) and/or service(s) advertised or for the company that advertises, manufactures, distributes, or promotes the products or services.
  3. There are certain categories of Advertisements that NWFR will not knowingly permit at any time. These categories include but are not limited to the following:

  4. Spots. DA shall provide the Sponsor with the use of thirty (30) second advertising spots or such other lengths or formats of advertising as NWFR and Advertiser may mutually agree (collectively, the "Spots") to be broadcast in (NWFRTV) as produced and to be aired on the agreed broadcast TV affiliates. All such Spots run by the Sponsor shall be subject to the above NWFRTV guidelines and current broadcast standards at time of airing. Once sponsor spots are delivered to DA or embedded in videos, DA has permission to air them as part of the program at its discretion.
  5. Future airings. Sponsorship elements, including all spots, may become a permanent part of the episode of the NWFRTV and may be aired at future dates and on other stations and in other markets. This will be at no cost to the sponsor. Changes or revisions to sponsor elements may be possible for a to be determined fee.
  6. Value of Spots & Sponsorship. The sponsorship value is outlined in the Cost & Terms section of the advertising agreement. Advertiser agrees that DA makes no guarantee regarding what the actual rating for any particular Program will be and, therefore, will not be obligated to provide any make-goods hereunder. The parties agree that no agency fees or other expenses may be deducted by Sponsor in any way from payment of the Total Sponsorship Value to DA.
  7. Representations and Warranties. DA and Sponsor each represent and warrant that this Letter Agreement has been duly authorized, executed and delivered by such party and that this Letter Agreement constitutes the legal, valid and binding obligations of such party, enforceable against it in accordance with its terms.
  8. Confidentiality. Neither party shall issue a press release or make any statement to the general public or any other party, concerning this Letter of Agreement, the Spots, Values, or the existence thereof, without the express prior written consent of the other.
  9. Cancellation. Either party can cancel this agreement with 60 days written notice to the other party. DA shall refund the appropriate prorated amount for TV spots or other elements not aired, outlined in the advertising agreement, within 30 days of cancellation or issue an invoice for the remaining sponsor balance. DA will assign a cost per current NWFRTV rates, for any camera work, editing or other work associated with sponsorship elements included in any cancellation settlements.
  10. Miscellaneous. This Letter Agreement and the exhibits and schedules included hereto constitute the entire agreement and understanding of the parties relating to the subject matter hereof and supersedes all prior and contemporaneous agreements, negotiations, and understandings between the parties, both oral and written. No waiver or modification of any provision of this Letter Agreement shall be effective unless in writing and signed by both parties.
  11. Governing Law and Jurisdiction. This Letter Agreement shall be governed by and construed under the laws of the State of Washington, Oregon, or Idaho as applicable to contracts fully performed in Washington, Oregon, or Idaho depending on the location of the broadcast affiliate under outlined in the advertising agreement, without regard to any states conflicts law. When a multi-station advertising agreement is executed, the contract shall be governed and construed under the laws of the State of Washington.
  12. Liability for Failure to Broadcast Sponsor elements or Spots. In the event that DA does not deliver the outlined sponsorship elements or spots in Northwest Fishing Reports TV within the outlined time frame plus 30 days, then the Total Spot Value and Sponsorship Value undelivered pursuant to the terms and conditions of this Agreement, then as liquidated damages and not a penalty, DA shall promptly either schedule mutually acceptable “makegood” advertising or pay Advertiser in cash an amount equal to the difference between the Total Spot/Sponsorship Value and the value of the Spots/Sponsorship actually telecast, as calculated in accordance with a prorated measure of the Total Sponsorship Agreement.
